Inside Cover of “Daisy Head Mayzie” – book, it reads, “Based on the animated television special created by Hanna-Barbera Cartoons Inc. in association with Tony Collingwood Productions.” 

That statement is clearly false (impossible), being that the "Daisy-Head Mayzie" - book is created, published and registered ‘before’ the “Daisy –Head Mayzie" –animated video; according to the United States Copyright Office, which shows beyond any hesitation whatsoever, that the defendants have clearly committed Fraud 380.(1) and Conspiracy 465.(1)(b). 

How can ‘something’ that is created first be based on ‘something’ that is created second? Indeed that statement by the Defendants is clearly unbelievable. This is called FRAUD!!!

Here is the evidence to show how Dr. Seuss Enterprises, L.P., stole a children's story and turned it into a fake lost work of Dr. Seuss! 

This shows how they created fake evidence in an attempt to cover up their crime. 

No original art work has ever been made available for independent verification of the fake book "DAISY-HEAD MAYZIE". 

On February 18th, 2015 a court case had been filed in Canadian Federal Court, case number T-231-15 by Charles Augustus Steen III, clearly showing exactly how DSE (Dr. Seuss Enterprises, L.P.) created false works and are distributing them as the lost works of Theodor Seuss Geisel aka Dr. Seuss, thus FRAUD 380.(1). There is no statute of limitations for fraud over $5,000.00. 

"The Pains of Being Pure at Heart" is a Children's Story which was written by Charles Augustus Steen III & copyrighted TXu-500-969 June 21st 1991 (95 days before Dr. Seuss passed away) and was submitted it to The Institute of Children’s Literature in CT. (Alvin Tresselt who was the Dean of Faculty at the time, had known Ted Geisel since 1948.)

The lawyers for Dr. Seuss Enterprises L.P. are non-other than David Foulds & Brendan Clancy. The American Lawyer is Christopher M. Young of DLA Piper whose area of practice is CLASS ACTION FRAUD DEFENSE. 

The lawyer for Random House of Canada is Brain MacLeod Rogers!! He is Canada's #1 lawyer for libel and defamation!! 

The strangest part about all of this is that on the date of filing I learned that Audrey Geisel is claiming to have discovered a "new original lost book" by Dr. Seuss called "What Pet Should I Get?" Hmmm? 

The reason this be being filed now is because I found out that Tish Rabe, Bonnie Worth, Aristides Ruiz and Joe Mathieu are the writers and artists of all the new Dr. Seuss books. And that Tish Rabe lives a few miles away from the Institute of Children’s Literature, where I submitted my children’s story “The Pains of Being Pure At Heart”

CONTRADICTORY STATEMENTS 

List of contradictory statements by the defendants from the library of congress copyright office, in newspapers and under sworn testimony. 

(Exhibit 13) Audrey Geisel clearly states, that she “found a 20 year old manuscript in the bottom of a drawer as she was renovating her house in La Jolla. Dr. Seuss wrote the story as a “screenplay”. He used typically whimsical verse and supplied a “complete set of original drawings”. Narrated by the Cat in the Hat. ”Daisy-Head Mayzie” is the story of a girl who suddenly finds a daisy growing out her head. She is taunted by schoolmates, chased by bees and scrutinized by those eager to solve her “problem” After an agent talks her into cashing in on her notoriety, Mayzie discovers the perils of overnight success and concludes that love means more than fame and glory. Random House executive Janet Schulman said the author’s files contain much other unpublished material. 

(Exhibit 32) "I've never gone out looking for anything," she says, speaking of the avalanche of adaptations and licensing. "It all comes to me." She volunteers this information to avoid the rap that she's exploiting Seuss and explains that by creating trademarks in various media, she's protecting her husband's creations. Yet some of Geisel's decisions, notably to publish some material that her notoriously perfectionist husband left unpublished, are difficult even for her to explain. NOTICE THE DATES ON THE BOTTOM OF THESE TWO FAXES!!! 

This is fabricated evidence. The dates, January 24 1991 of the letter and February 7th 2002 of the FAX. It states “In case Ted has forgotten about or lost his copy of DASY-HEAD-MAZIE, we are glad to have been able to recover the work.” WTF? 

(Exhibit 42) letter from Steven Paul Leiva to Herb Cheyette from ICM fax “As per our conversation the other day I’m enclosing a copy of the above-mentioned story by Dr. Seuss (DAISY-HEAD MAYZIE) We found this in our files. It seems that Ted submitted to us many moon ago” …. “ In any case if Ted has forgotten about and/or lost his copy of DAISY-HEAD MAYZIE we are glad to have been able to recover the work.” 

* This statement contradicts (Exhibit 13) the so-called manuscript that was found in a drawer lost for 20 years meaning it was created in 1974 and not at Chuck Jones Productions. 

(Exhibit 43) letter from Herb Cheyette to Steven Paul Leiva from ICM fax “Thanks so much for letter of January 24, with enclosures. I have discussed “Daisy-Head Mayzie” with Ted, who informs me that he is currently considering other uses for the story.” 

* This statement contradicts (Exhibits 13 & 42), for why would Ted (Dr. Seuss) be considering other uses for the story? Why would the so-called manuscript be in the possession of Herb Cheyette, who the book is dedicated to (Exhibit 20), and not lost in the bottom of a drawer, for 20 years? These were sent via FAX to Stacy Ison at the Willamette Week, in Portland Oregon from Herb at ICM on February 7th 2002. 

NOTE: both Chuck Jones and Ted Geisel would have been alive during the time of this fraudulent correspondence between Steven Paul Leiva & Herb Cheyette. 

Chuck and Ted would not have had Herb Cheyette or Steven Paul Leiva do their talking for them, when they were known to be very close friends from 1943 when they collaborated on "Private Snafu". The name "Private Snafu" comes from the unofficial military acronym SNAFU ("Situation Normal: All F***ed Up"). I believe it is safe to assume that they knew how to use a telephone, even in their old age. Ted did all of his negotiations himself up until his death, when Audrey and Karl ZoBell took control of his property and created Dr. Seuss Enterprises, L.P. 

(Exhibit 56) statement of Audrey Geisel. “Two books were published after his death, based on upon preliminary drafts done while he was alive, but never finished by him.”….“Neither I, nor my attorney’s, nor my husband’s publisher (Random House) could see any similarities in the art, plot or language.” With “EXAMPLES OF ART-PLOT-LANGUAGE” clearly showing copyright infringement and fraud, false statement and fraudulent concealment. 

*This statement contradicts Audrey’s first statement in (Exhibit 13) being that Audrey stated that she “found a 20 year old manuscript in the bottom of a drawer as she was renovating her house in La Jolla. Dr. Seuss wrote the story as a “screenplay”. He used typically whimsical verse and supplied a “complete set of original drawings”. 

(Exhibit 57) statement of Karl ZoBell, “Mr. Steen sent us an email copy of his book. It had no recognizable similarity to the Dr. Seuss book in question. Further, we, and Mr. Geisel’s agent, had clear proof that the Dr. Seuss book in question had been put to paper by him years before the Steen work was put together by him. After the lawsuit failed, Mr. Steen began a course of sending frequent e-mails to me, and to my partner, Cathy Ann Bencivengo. * If ZoBell and Audrey have ‘clear proof’ let’s see it!! Show ‘us’ the original. To be verified by a forgery expert with Ted’s fingerprints & his DNA in front of a Judge and Jury, under sworn testimony. The ‘original manuscript’ has NEVER been made public. 

(Exhibit 62) Bencivengo said the manuscript for "Daisy-Head Mayzie" was written in the 1960s, before Steen was born. 

* This statement contradicts (Exhibit 13) being that Audrey stated it was 20 years old in 1994, thus making its creation date in 1974, which would also contradict (Exhibits 17, 18 & 20) 

The book was inspired by 'The Pains of Being Pure at Heart' written by Charles Augustus Steen III and copyrighted 95 days before Dr. Seuss died.

THE SIMILARITIES IN ART

These are the e-mails from Cathy Ann Bencivengo in April of 2001.

In the e-mail from Cathy Ann Bencivengo April 16th 2001 the arresting officer W. E. Skip Stephenson deleted the line where is says, "As you (Cathy Ann Bencivengo) said over the telephone, "WE CAN RESOLVE THIS ISSUE WITHOUT GOING TO COURT" basically means settle. 

Ok, I admit that these emails are a bit much, but I was clearly upset, and I was broke and I was devastated. What they did to me was like raping my soul. It is clear and from the evidence above that DSE lied 100% to have me arrested on the 5th of November 2003. I NEVER contacted Audrey Geisel. And I NEVER wrote in any e-mail, "Or I'll do something you'll regret.", as Cathy Ann Bencivengo said. Those statements in the press are 100% distorted LIES!!

NOTE: I refiled the case in New Mexico on the grounds of Fraud Upon The Court and the new acting Judge was Judith C. Herrera of the Federal Court in Albuquerque. This Court appears to have also misrepresented the facts in regards to the nature of the case (Exhibits 78 ). Notice that it states that the acting Judge is Judith C. Herrera, not Bruce Black from 22-06-2001 until 18-06-2003 (Exhibits 34 & 78), and notice that it shows the old lawyers Cathy Ann Bencivengo & Matthew C. Bernstein, not Christopher M. Young of DLA Piper – ‘Class Action Fraud Defense’ from 20-03-2013 until 18-12-2013 as clearly stated in (Exhibit 79). The argument of 18 USC 1513 (e)(f)(g) was never brought up by the New Acting Judge Judith C. Herrera. 

HERE IS THE E-MAIL THAT I SENT TO ALL OF THE LAWYERS AT Gray Cary Ware & Freidenrich LLP (Now DLA Piper) on August 4th 2001. In which I attached my Daisy-Head Mayzie Parody Painting.

On September 9th, 2003 I e-mailed Karl ZoBell this letter with an attachment of my play The Tragical History of Audrey Geisel or How The Grinch Plagiarized My Goddamn Children's Story. I have blacked out my friend's name because he is a published author as well as a respected journalist and he doesn't want any part of all this insanity. 

I was arrested by W. E. Skip Stephenson on the 5th of November 2003. Remember, he is the Police Officer who distorted the evidence, and who technically committed 10 counts of perjury and obstruction of justice, (pages 36 through 43 of the Document Filed on February 18th, 2015) by lying and editing the e-mails from Cathy Ann Bencivego to me in 2001, and said that the case had been dismissed when it had not. Skip managed to bamboozle the Portland Police. He wrote the I contacted Audrey Geisel, whom I did not. I was angry for having been plagiarized and I wanted a settlement. I honestly did not know that I would get arrested for being a sarcastic little smart ass. 

Audrey even lied to Arnold Schwarzenegger, who was the Governor of California at the time, getting him to sign my extradition letter.

The lawyer for Dr. Seuss Enterprises, L.P. is non-other than Karl ZoBell of DLA Piper the world's biggest law firm with 4200 lawyers, who is also a Director for The Copley Press, owner of The San Diego Union Tribune which smeared my name. It just so happens that J. Tony Serra's brother Richard Serra received $1,000,000.00 from The Museum of Contemporary Art in San Diego to whom Copley Press donated money as well. I was set up and sold out. 

I have lost business opportunities because of the trumped up extortion charges leveled at me. I need to set the record straight and clear my name. My record was expunged on April 17th 2006 but the court of public opinion has never been corrected.

My lawyer was non-other than J. Tony Serra, who told me that it did not matter that I could prove that they plagiarized my story or that I could prove the W. E. Skip Stephenson distorted the facts in order to have me arrested. He said Audrey would buy off the Judge and the Jury. Personally I had a lot of respect for The Honorable Judge Joseph Maguire, because I think he wanted me to stand up for myself and prove these people wrong in their hometown, but instead of listening to my gut, I listened to J. Tony Serra.

When I met J. Tony Serra at his office, I gave him an 11 page rebuttal showing that the case was not dismissed. At that time, on April 16th 2001, Cathy Ann Bencivengo asked over the telephone for terms for a settlement. This is the e-mail that DSE used against my for extortion. They wrote that the case was dismissed when this e-mail was written, that is not the truth, the case was "dismissed without prejudice" on the 18th of June 2003, by The Honorable Judge Bruce D. Black, 793 days after Cathy Ann Bencivengo e-mailed me. NOTE: Cathy's maiden name is Palumbo. Also in the police report by W. E. Skip Stephenson, he had deleted much of the e-mails and LIED about the case being dismissed at the time of this e-mail. All of this is documented in the case I filed on February 18th 2015. 

After I had completed my 18 months of Probation and 200 hours of Community Service I had my record expunged on April 17th, 2006, and found NOT GUILTY of extortion....

* This statement contradicts (Exhibits 13, 17, 18, 20, 42, 43, 56, 57 & 62), clearly showing fraud on part of Audrey Geisel, Steven Paul Leiva, Herb Cheyette (deceased), Karl ZoBell & Cathy Ann Bencivengo.

* The only way for Audrey Geisel & Karl ZoBell to be found ‘not guilty’ of fraud & fraudulent concealment, would be to provide the original of the so-called manuscript of Daisy-Head Mayzie with a ‘complete set of original drawings’ (Exhibit 13) to be verified by an unbiased forgery expert in front of a Judge and Jury, under sworn testimony, and then explain all the rest of the contradictory statements as well as conflicting copyright, and at the same time explain the fact that there is the exact same phrase at the end of each story (remember that mine was copyrighted first 95 days before Dr. Seuss Died): "THESE ARE THE WORDS THAT". 

*There is no mention of the ‘lost work’ Daisy-Head Mayzie in Charles Cohen's biography “The Seuss, The Whole Seuss & Nothing But The Seuss.” (Exhibit 49).

They are now claiming that the book was written in the 1950, being 40 years old when it was first claimed to be 20 years old. 

I WAS INFORMED BY RANDOM HOUSE AUTHOR  & DR. SEUSS SCHOLER PHILIP NEL, THAT DR. SEUSS DID IN FACT DRAW A PICTURE OF A GIRL WITH A FLOWER GROWING OUT OF HER HEAD IN "The Cat's Quizzer" page 38 (1976) 

And preceding "The Cat's Quizzer" the Cover of MAD MAGAZINE (1969) had an image with of Alfred E. Neuman with flowers growing out of his head as well.  That is why Cathy Goldsmith and Audrey Geisel changed their story to the 1950's, yet this evidence speaks for itself.

Notice the letter "Y" in the word 'MONEY' drawing for "One Cent, Two Cents, Old Cent, New Cent" and the letter "Y" in the word yellow, in the newly discovered book. Aristides Ruiz is an artist for many of the "Dr. Seuss" books written by Bonnie Worth and Tish Rabe. The lines are way too clean to be Ted's art!!

Tony Serra for what they truly are, well, I had no choice. These individuals are absolutely beyond words; what they have done not only to me, but to the good name of Dr. Seuss is literary treason and unforgivable. 

These individuals are very powerful and will most likely stop at nothing from the truth of this of being known. I filed the lawsuit because I could not deal with the label of extortionist any longer. If I was guilty of anything, it was being a smart -ass, but I never lied about copyrights or distorted the facts.
